Terms and conditions
By using La Perla you accept what this page says. If you disagree with any of it, don't use the app.
1. What La Perla is
La Perla connects visitors to Margarita with partner businesses. We provide the platform: the pass, the benefit catalogue, redemption and Perla Points. The benefits are provided by the business, not by us: the meal, the discount or the activity are theirs, and so is the responsibility for their quality.
2. Your account
- It's personal. Don't lend it or sell it.
- The details you enter must be true: the business checks your name when you redeem.
- You're responsible for what happens from your session. If you think someone got in, sign out from the app and change your password.
- We may suspend an account that breaks these terms or uses the platform to defraud a business.
3. The pass
- It unlocks the benefits of its destination while it's valid, as stated when you buy it.
- It is personal and non-transferable. The business may ask for ID.
- You can hold several active passes; when redeeming, the one that applies to that benefit is used.
- Renewing before it expires adds the time you had left.
4. Benefits and redemptions
- Each benefit has its own conditions: hours, days, a savings cap and a maximum number of redemptions per day. They're shown in the app before you redeem.
- Redemption happens at the venue, with a QR code. Once done, it can't be undone.
- A business may decline to apply a benefit if its conditions aren't met or the pass isn't valid.
- Partner businesses change over time. We make reasonable efforts to keep the catalogue current, but we don't guarantee any particular business will still be there.
5. Perla Points
- Earned by using the app: redemptions, challenges and passport stamps.
- They are not money. They can't be bought, sold, transferred or exchanged for cash.
- They're used to redeem the benefits a business has priced in points.
- They don't expire today. If that ever changes, we'd tell you in the app in advance.
- We may correct a balance credited in error or through fraudulent use.
6. Prices and payments
- Passes are priced in US dollars.
- If you pay through a bolívar method (C2P or mobile payment), the amount is converted at the official Central Bank of Venezuela rate for the day and locked when the payment starts: what you see on confirming is what gets charged.
- With mobile payment you must transfer the exact amount and give us the reference. A different amount can't be accepted, because the bank won't match it.
- The pass activates once the payment is confirmed. With mobile payment this can take a while, since it depends on the bank seeing the transfer.
- Refunds: an activated pass isn't refundable, unless you couldn't use it because of a failure on our side. In that case write to us and we'll handle it case by case.
7. Acceptable use
You may not:
- Use the app to obtain benefits you're not entitled to, or lend your account or QR code to someone else.
- Automate use, scrape content or try to get around redemption limits.
- Interfere with the service or try to access other people's data.
8. Liability
We make reasonable efforts to keep the app working, but we don't guarantee it will always be available or free of errors. We're not responsible for the quality of what a partner business provides, nor for indirect damages arising from using the app. None of this limits the rights the law gives you as a consumer.
9. Changes and termination
We may change these terms; if the change matters, we'll tell you in the app before it takes effect. You can stop using La Perla and delete your account whenever you like — that doesn't refund a pass in progress or bring back spent points.
10. Governing law
These terms are governed by the laws of the Bolivarian Republic of Venezuela, and any dispute is submitted to the competent courts. The following apply in particular:
- Habeas data, established in article 28 of the Constitution of the Bolivarian Republic of Venezuela.
- Protection of honour, privacy and image, article 60 ejusdem, which gives users the constitutional right to know what data companies hold about them and how it is used, and to demand that it be updated or deleted.
- The Ley Especial contra los Delitos Informáticos (Special Act against Computer Crimes), articles 20, 21 and 22, on improper access to, disclosure of or sale of data, which impose criminal penalties for extracting, selling or misusing customer databases without explicit consent.
- The Ley sobre Mensajes de Datos y Firmas Electrónicas (Act on Data Messages and Electronic Signatures), article 5, which establishes that information collected by electronic means or servers must preserve the confidentiality of the parties.
How we handle your data is in the privacy policy.
